HB 220, a bill that changed the title of the crime of "Child Pornography" to the crime of  "Child Sexual Abuse Images", will take effect on Sunday. HB 220 was introduced by Representative Renny Cushing in an effort to ensure that terminology used in the Criminal Code adequately reflects the nature of the offense. The bill was passed with broad bi-partisan support and was signed into law by Governor Sununu at a public signing ceremony on June 7th. 
“Categorizing a sexual image of a child as ‘pornography’ rather than ‘abuse’ trivializes the experiences of child victims. Changing the title of this law helps remind us that those who produce images of child sexual abuse are creating a permanent record of their crime, and that the child is victimized each time these images are shared. It’s important that we recognize this heinous crime for what it really is – child sexual abuse,” said Amanda Grady Sexton, Director of Public Affairs at the NH Coalition Against Domestic and Sexual Violence.

Today we learned that State Representative Eric Schleien has been charged with one count of sexual assault and two counts of simple assault against a 16-year-old girl. Representative Schleien is innocent until proven guilty, but these allegations are alarming. Sadly, cases of sexual violence in NH continue to grab national headlines, and a recent study by the CDC ranks NH as having one of the highest rates of sexual violence in the nation. In response, The Coalition Against Domestic and Sexual Violence is working with state leaders to craft a comprehensive legislative agenda to address a number of inadequacies in our current sexual assault laws. In addition, we will work to help prevent sexual violence by working to establish opportunities for all students in NH to receive age-appropriate prevention education.

"We commend the Attorney General's Office for taking action to investigate the potential mishandling of sexual misconduct at St. Paul's School – they are right to shine a light on the darkness that continues to surround this school. The administration's practice of hiring outside 'investigators' to determine whether to report suspected criminal activity to law enforcement points to a culture that places the school's reputation far above the health and safety of the children entrusted to its care.  Elite boarding schools are in many ways exceptional, but they are not above the law.  

While administrators at St. Paul's School recently disclosed a decades-long history of sexual assault and misconduct on campus, they seem to be unwilling or unable to comprehend the ongoing problem unfolding right in front of their eyes today. This investigation is an opportunity for the School to assess the reality of sexual misconduct on their campus and take the proper steps to craft model policies, establish a prevention plan, train faculty, and connect students to support services."

We commend the victim in the Manchester West case for her bravery in coming forward. Her strength has shed light on the glaring need for schools to improve their prevention efforts and prioritize student safety. It is cases like these that highlight the importance of prevention education in our schools. Each of NH's 13 crisis centers work with schools in their communities to implement age-appropriate prevention programming that aims to give students, faculty, and administrators the necessary tools to keep their student body safe.
As Manchester West officials look ahead to the 2017-18 school year, we strongly encourage them to contact their local crisis center when establishing a plan to prevent future violence, educating their staff on reporting requirements, implementing educational programs, and crafting model policies. 

Parents of Lizzi Marriott to speak at bill signing ceremony celebrating the passage of NH’s newly strengthened Rape Shield
(Concord, NH) On Wednesday, June 7th at 3:00 p.m., victim advocates will be gathering in the Executive Council Chambers at the State House to celebrate four significant victim protection bills being signed into law, including legislation that safeguards rape victims’ legal rights to privacy and enhances protections for child victims. “Rarely have we seen a year in which victims’ rights and protections have been so much at risk, and we are incredibly grateful to work with a Legislature that understands the importance of protecting the rights of our most vulnerable citizens,” said Amanda Grady Sexton, NHCADSV Director of Public Affairs. “We are grateful to the Legislature and Governor Sununu for their leadership on behalf of crime victims in New Hampshire.”
The following bills will be signed at the ceremony:

• SB 9, relative to the admissibility of proffered evidence in sexual assault cases.

This legislation was introduced in response to a recent NH Supreme Court decision and strengthens NH's Rape Shield Law to ensure that the private, unrelated sexual history of sexual assault victims will not be used against them in any court proceeding. 
This bill seeks to do two critical things. First: it will ensure that the private, unrelated sexual history of victims will remain sealed in all NH court proceedings, including on appeal. Second: it defines “sexual activity” for the purposes of rape shield. This is the most critical piece of the bill, as it will give judges guidance in application of rape shield protections, and will make clear what protections are afforded to victims in rape cases. This bill strikes a balance between protecting victims’ privacy while not infringing on defendants’ due process rights, and lays out a procedure for defense attorneys wishing to have a judge rule on evidence they wish to submit. This bill shall take effect 60 days after being signed by the Governor.
“We applaud the Legislature and Governor Sununu for prioritizing this critical issue brought to light before the Supreme Court in the case of Seth Mazzaglia. Moving forward, victims of sexual violence will not need to question whether or not the courts will protect their past, unrelated sexual history from being used against them in the courtroom,” said Amanda Grady Sexton, NHCADSV Director of Public Affairs.

• SB 166, relative to termination of the parent-child relationship in cases of sexual assault.

This bill will make it easier for victims that become pregnant as a result of rape to terminate the parental rights of the rapist. Under current law, if a victim of sexual assault becomes pregnant and has a child as a result, the burden of proof is on the victim to prove beyond a reasonable doubt that termination of parental rights of the rapist is in the best interest of the child. SB 166 shifts the burden of proof from the survivor to the rapist, and will make it easier for these victims to raise their children safely. This bill shall take effect January 1, 2018.
“By shifting the burden of proof in these cases from the rape victim to their attacker, we are protecting victims and children from being re-traumatized by having to prove that the rapist shouldn’t have access to them and their children. This gives them back control over their lives and allows them to raise their children safely,” said Amanda Grady Sexton, NHCADSV Director of Public Affairs.

• HB 94, prohibiting certain defenses in prostitution and human trafficking cases and relative to fines assessed for certain offenses involving domestic violence.

This bill amends NH's human trafficking statute to prohibit johns from using certain legal defenses after being charged with purchasing sex from a minor. The bill makes clear that neither lack of knowledge of a victim's age, nor the "consent" of a minor, can be used as a defense in human trafficking cases. HB 94 prevents johns from being able to use "I didn't know how old she was" as an excuse for purchasing sex from a minor. 
Further, this bill contains a clarifying amendment that a $50 fine shall be levied on all convictions under Joshua's Law—language that was originally passed in 2015. This bill shall take effect January 1, 2018.
“This bill will ensure that those soliciting sex from children are held accountable for their actions, and will allow the criminal justice system to more adequately protect at-risk children and youths,” said Amanda Grady Sexton, NHCADSV Director of Public Affairs.

• HB 220, amending the title of the chapter relating to child pornography.

This bill changes the term "Child Pornography" to "Child Sexual Abuse Images" to better reflect the nature and severity of the crime. The title of NH’s law relative to sexual images of children was already amended under the Online Child Safety Act of 2008. The bill passed with broad bipartisan support; however it failed to update the chapter’s title. “Child Pornography” is a misnomer. This bill shall take effect 60 days after being signed by the Governor.
“Children cannot consent to making pornography and shouldn’t be associated with an industry based on the selling of sex. These images are not pornography, they are evidence of sexual abuse, and we need to recognize this heinous crime for what it is,” said Amanda Grady Sexton, NHCADSV Director of Public Affairs.
